These Terms of Service govern your use of nocturyl.com and any purchase you make from it. By browsing this site or placing an order, you accept these terms. If you do not accept them, please do not use the site.

nocturyl.com is operated by Noah's Ark Studios, Vendelpad 7, 2722 AL Zoetermeer, The Netherlands. KVK number 86963260. VAT identification number NL004333380B55. Nocturyl is a brand of Noah's Ark Studios, and Noah's Ark Studios is the seller and contracting party for every order placed on this site.

In these terms, "Nocturyl", "we", "us" and "our" mean Noah's Ark Studios, and "you" means the site visitor or customer.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to order from this site. By ordering, you confirm that you are. Our products are not intended for anyone under 18.

2. Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt of that offer; it is not acceptance. The contract is formed when we dispatch the order.

We may refuse, limit or cancel any order, in whole or in part, at our discretion, including where there is a suspected error in pricing or listing, suspected fraud, an order that appears to be for resale, a history of excessive guarantee claims, or where we cannot verify the payment or delivery details. If we cancel a paid order we refund it in full.

3. Pricing and errors

Prices are in US dollars and exclude taxes where applicable. We try to keep pricing, imagery, ingredient information and descriptions accurate, but errors happen. If an item is listed at an incorrect price or with an incorrect description, we may cancel the order and refund you in full, even after a confirmation email has been sent. Prices may change at any time. Promotional prices apply only for the period stated and cannot be applied retroactively.

4. Promotions, discounts and on-site messaging

Discount codes, bundles and promotional offers are subject to their own stated terms, cannot be combined unless we say so, have no cash value, and may be withdrawn at any time. Countdown timers, stock indicators, visitor counters, shipping-date estimates and similar on-site elements are provided for information only, are generated automatically, and are not offers, guarantees or contractual terms.

5. Subscriptions and recurring payments

If you choose a subscription, you authorise us to charge your payment method on a recurring basis at the stated price and frequency until you cancel. You may cancel at any time from your account, and we will not require a phone call or a form. Cancellation takes effect for future renewals only; an order already charged or dispatched is handled under our Refund & Guarantee Policy. Cancel at least 24 hours before a renewal date. We will notify you in advance of any change to price or frequency.

6. Payment

Payments are processed by third-party payment providers. We do not store full card details. You confirm that you are authorised to use the payment method you provide. If a payment is declined, reversed or charged back, we may suspend or cancel the related order and decline future orders. Please contact us before opening a dispute with your bank; see the Refund & Guarantee Policy.

7. Shipping, refunds and guarantee

Our Shipping Policy, Refund & Guarantee Policy and Legal Notice form part of these terms and are incorporated by reference.

8. Health, supplements and medical disclaimer

This is the most important section on the page. Please read it.

• 3AM is a dietary supplement. It is not a drug and it is not a treatment.
• These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.
• Nothing on this site, in our emails, advertisements, articles, advertorials, quizzes or customer stories is medical advice, and none of it establishes a practitioner relationship. It is not a substitute for advice from your doctor, pharmacist or other qualified professional, and you should never delay or disregard professional advice because of something you read here.
• Consult a qualified professional before use if you are pregnant, trying to conceive or nursing; if you are under 18; if you take prescription medication, including thyroid medication, antibiotics, diuretics, or medication for cardiac or kidney conditions; or if you have any medical condition, particularly kidney impairment.
• Magnesium can reduce the absorption of certain medications. Separate doses by two to four hours and confirm with your pharmacist.
• Check the full ingredient list before use if you have allergies or sensitivities.
• Do not exceed the suggested use stated on the pouch. Keep out of reach of children.
• Stop use immediately and seek medical advice if you experience an adverse reaction.

9. No guarantee of results

Individual results vary, and nothing on this site is a promise of any outcome. Where we describe research, we describe it as it is: the published evidence on magnesium and sleep shows a modest effect, strongest in people whose magnesium intake is low to begin with. Our money-back guarantee is a commercial guarantee about your money. It is not a guarantee that the product will produce any particular result for you.

10. Reviews, testimonials and endorsements

Customer reviews, testimonials, photographs, ratings and stories published on this site describe the individual experience of the person who gave them and are not necessarily typical. They are not a guarantee, warranty or prediction of what you will experience, and they are not medical evidence.

Where a review is marked as verified, that means our review system has matched it to an order. Where a contributor has received a free product, a discount, a payment or any other benefit, that connection is disclosed. Advertorial and editorial-style articles on this site are advertising content published by Noah's Ark Studios unless stated otherwise.

11. Content you submit

If you submit a review, photograph, comment or other content, you confirm that it is your own, that it is truthful, that it does not infringe anyone's rights, and that it contains nothing unlawful, defamatory or obscene. You grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, adapt and publish that content in connection with our products and marketing, including in advertising, without further consent, credit or payment. You may ask us to remove your content and we will do so within a reasonable period, subject to material already distributed. We may remove or decline to publish any submission at our discretion.

12. Intellectual property

All content on this site, including text, copy, imagery, video, graphics, formulation descriptions, page design, the Noah's Ark Studios and Nocturyl names and the 3AM product name, is owned by or licensed to us and is protected by intellectual property law. You may view and print it for personal, non-commercial use. You may not copy, republish, scrape, resell, adapt or use it commercially, or use our name or marks, without our prior written permission.

13. Acceptable use

You agree not to use this site for any unlawful purpose; not to attempt to gain unauthorised access to it; not to introduce malicious code; not to scrape, crawl or harvest data from it by automated means without our permission; not to place fraudulent orders; and not to interfere with its normal operation. We may suspend or terminate access to anyone who breaches this section.

14. Third-party links and services

This site may link to or embed third-party sites and services, including payment providers, carriers, review platforms and analytics tools. We do not control them, we are not responsible for their content, availability, practices or policies, and a link is not an endorsement. Your use of a third-party service is governed by that party's terms.

15. Disclaimer of warranties

To the fullest extent permitted by law, this site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, or that any information on it is complete or current. Nothing in this section excludes any warranty that cannot lawfully be excluded, and nothing in these terms limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be limited.

16. Limitation of liability

To the fullest extent permitted by law, and subject to the final sentence of section 15:

• we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, data, goodwill, opportunity or anticipated savings, however arising;
• our total aggregate liability arising out of or in connection with these terms, your use of the site, or any product you buy from us, is limited to the amount you actually paid for the order giving rise to the claim;
• this limitation applies regardless of the legal theory on which a claim is based, and applies even if we have been advised of the possibility of the loss.

17. Indemnity

You agree to indemnify and hold harmless Noah's Ark Studios, its officers, employees, suppliers and agents against any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

18. Governing law and disputes

These terms, and any dispute or claim arising out of or in connection with them or with any order placed on this site, are governed by the law of the Netherlands, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

The competent court is the Rechtbank Den Haag, the Netherlands.

If you are a consumer, nothing in this section deprives you of the protection of mandatory provisions of the law of your country or state of residence, or of any right you have to bring proceedings before the courts there.

Any dispute must be brought in your individual capacity and not as a plaintiff or class member in any purported class, consolidated or representative proceeding, to the fullest extent permitted by law.

Please contact us first. Nearly every dispute we have ever had was a misunderstanding that an email resolved in a day.

19. Privacy

Our Privacy Policy explains what personal data we collect and how we use it, and forms part of these terms. Noah's Ark Studios is the controller of that data.

20. Changes to these terms

We may update these terms at any time by posting a revised version here. Changes take effect when posted. The version in force when you place an order governs that order. Please check this page periodically.

21. General

If any provision of these terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours in connection with a merger, acquisition or sale of assets. These terms, together with the Shipping Policy, Refund & Guarantee Policy, Legal Notice and Privacy Policy, are the entire agreement between us and replace any prior understanding.
